Labor certification exempt categories
While certain positions require labor
certification, others do not. Our firm assists clients with required
labor certificate documentation when necessary. However, employees in
the following categories do not require labor certification to obtain
visas:

- Outstanding professors and researchers
- International executives and managers
transferred from abroad
- Persons with advanced degrees or of exceptional
ability whose work is in the national interest (National Interest
Waiver)
- Investors who invest $1 million (or $500,000 in
certain areas) and create employment for ten U.S. workers

- Intracompany transfer work visas for
individuals employed abroad as executives, managers or in positions
requiring specialized knowledge

- Individuals with extraordinary abilities in
fields of science, arts, education, business, or athletics at the
national or international level, including extraordinary achievements
within the motion picture and/or television fields
- P
- Individuals internationally recognized as
athletes, artists, or entertainers
