Immigration Bonds and Habeas Corpus

Immigration bail bonds are cash bonds paid directly to Immigration and Customs Enforcement (ICE) or the Immigration Court. Such bonds guarantee appearance at Immigration Court proceedings and compliance with Department of Homeland Security (DHS) obligations. Unless the immigrant fails to meet DHS obligations, once deportation and removal proceedings are over, the bond money is returned to the party securing the cash bond.

Habeas Corpus

A writ of habeas corpus petitions the court to determine whether unlawful detainment occurred. U.S. constitutional law provides people in the United States with freedom from unlawful imprisonment.
